Terms & Conditions for Kaddyshack Society Members
These terms and conditions set out the basis on which we supply and by which you may use the Kaddyshack members programme and membership Card ("the Card"). Please read these terms and conditions carefully and retain them for future reference.
INFORMATION ABOUT US 
Kaddyshack Golf and the Kaddyshack Membership scheme is owned by DDS and licenced and operated in Ireland by DDS Management Limited, Registered Company number 374920, whose registered office is at No1 Glencarney Drive, Pairc na Gloine, Kenmare, Co. Kerry, Ireland. The scheme offers discounts at the golf clubs ("Participating Venues"), Hotels ("Participating Venues"), Equipment, Events and Holidays ("Participating Venues & Country's") named on the Kaddyshack Membership website at http://kaddyshackmembership.blogspot.com/ against the standard fees charged by such venues.

YOUR STATUS
In order to use the Card you must be aged 18 or over and a resident of the Ireland or United Kingdom, Europe, The world. 


MEMBERSHIP

Membership is a once of payment, fee charges set at the time accordingly. 

USE OF THE CARD
The Card remains the property of DDS Management Limited at all times.

Each Card is valid for a period of one year from date of purchase.

The Card cannot be used in conjunction with any other offer or promotion. The Card, once activated, is non transferable, not for sale, resale or redeemable for cash. Cash value 0.001p.

The enjoyment of the discount available by using the Kaddyshack Membership card is personal to you as the holder of the Card. More than one Card holder may obtain a discount within a booking, however the discount is only applied to each individual holding a current and eligible Kaddyshack Membership Card.

In order to use the Card, you must first activate your Kaddyshack Membership Card, which is possible at (
http://www.kaddyshackgolf.net/) and complete the necessary steps to activate the Card. The Card cannot be used without first completing this activation process. No alternative method is available to activate the card and Card holders must be able to access the Internet to activate their Card and to enjoy the benefits of membership. 

The Card allows you as a Card holder to enjoy the discount advertised for the selected Participating Venues, which to the extent of any conflict or inconsistency supersedes any other discount advertised in any printed literature issued by us or by any Participating Venue.

Only genuine Kaddyshack Membership Cards featuring are encoded with a valid number, will be accepted by participating Venues. Photocopies will not be accepted.

The Card may be used at any of the participating Venues; however the Card may only be used at each individual Participating Venue once per day.

In order to obtain the advertised discount, you must first contact the venue by telephone in order to book a tee time, room, or any other placings. Following booking, the Kaddyshack Membership Card must be handed over when paying your fee, prior, in order that it can be verified by the Participating Venue. You must observe the rules of the individual Participating Venue as provided, including the dress code of the Club. DDS Management Limited can accept no responsibility for the discretion of an individual Participating Venue in determining whether the Participating Venue rules have been observed.

These terms and conditions must be read in conjunction with the terms and restrictions unique to each Participating Venue shown on the Kaddyshack Membership section on the website. Individual clubs may impose date, age, handicap or other restrictions - please telephone your chosen venue prior to your booking to avoid disappointment and for details of availability and opening times. Individual Participating Venues retain the right to vary prices and/or availability without notice.

Any single Kaddyshack Membership Card booking must comprise of no more than 2 persons (or as specified by each Participating Venue at the time of booking). Card usage is strictly for casual usage only and cannot be used by you as a substitute or part payment for any society/corporate booking for formal competition play where prizes are presented. Separate bookings on any one day by groups of players who are deemed to be part of the same party and which in total exceeds the maximum number of players as allowed by each Participating Venue, may not claim the Kaddyshack Membership Card discount without the express agreement of the Participating Venue at the time of booking.

The number of times you are allowed to use the Card at each Participating Venue in any 12 month period may be limited by the Participating Venue. Please check this at time of booking. Card use is strictly monitored at the Participating Venues when the
number of visits is restricted.

At some of the Participating Venues only Card holders with official club handicaps will be allowed to play. In these cases you will be asked to present a current handicap certificate on arrival. If you do not have a certificate, you will not be allowed to play. It is your responsibility to check with the Participating Venue whether a handicap certificate is required.

The details of the Participating Venues published on our website are based upon information supplied by the Participating Venues and may be subject to change without notice. Whilst every care has been taken to ensure the accuracy of such details at
the time of publication of our website, you must telephone the Participating Venue prior to booking travel or other arrangements to check that all published information is correct.

The Card cannot be used in conjunction with any other short term incentive, green fee discount, promotion or otherwise which the Participating Venues may from time to time advertise. It is up to you to check whether the Participating Venue is offering a more favourable rate than available through Kaddyshack Membership Card and we accept no liability for you having used the Card instead of having taken advantage of a more favourable short term incentive, green fee discount, hotel promotion or otherwise.

Whilst each Participating Venue has confirmed its willingness to participate in this offer, Kaddyshack Membership Card cannot be held responsible for any Participating Venues declining acceptance of the Card for reasons of their own, nor can they be held responsible should any Participating Venue cease to trade. Kaddyshack Membership Card can accept no liability for loss or personal injury suffered at Participating Venues except to the extent that Kaddyshack Membership Card are required to accept such liability by law. This does not affect any of your statutory rights as a consumer. In the unlikely event that the Participating Venue fails to honour the discount as advertised on the Kaddyshack Membership Card website, you should request a receipt for the transaction with the Participating Venue and forward this to DDS Management Limited, No1 Glencarney Drive, Pairc Na Gloine, Kenmare, Co. Kerry, Ireland.

Kaddyshack Membership Card shall not be held responsible for the suitability or otherwise of Participating Venues. Any dispute must be settled direct with the Participating Venue concerned.

Kaddyshack Membership Card will accept no responsibility for the inability of a Participating Venue to accommodate a booking for a tee time, hotel reservation, holiday booking requested.

Kaddyshack Membership Card Card shall have no liability to you by reason of any representation (unless fraudulent) or any implied warranty, condition or other term, or any duty at common law or under any express term of these conditions for any costs of travel, accommodation, loss of expectation, other financial or like loss or any indirect, special or consequential losses.

WRITTEN COMMUNICATIONS 

When activating the Card, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our site. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

NOTICES 

All notices given by you to us must be given to DDS Management Ltd, No1 Glencarney Drive, Pairc Na Gloine, Kenmare, Co. Kerry, Ireland. or emailed to kaddyshack We may give notice to you at either the e-mail or postal address you provide to us when activating your Card. Notice will be deemed received and properly served immediately when posted on our website, 48 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

TRANSFER OF RIGHTS AND OBLIGATIONS 

You may not transfer, assign, charge or otherwise dispose any of your rights or obligations arising under these terms and conditions, without our prior written consent.

We may transfer, assign, charge, sub-contract or otherwise dispose of any of our rights or obligations arising under these terms and conditions at any time during the validity of your Card.

EVENTS OUTSIDE OUR CONTROL
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms and conditions that are caused by events outside our reasonable control (Force Majeure Event). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following: Strikes, lock-outs or other industrial action. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster. Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport. Impossibility of the use of public or private telecommunications networks. The acts, decrees, legislation, regulations or restrictions of any government. Our performance under any of these terms and conditions is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under these terms and conditions may be performed despite the Force Majeure Event.

PRIVACY
When you activate your Card you acknowledge and agree to be bound by the terms of our Privacy Policy available at www.kaddyshackmembership.blogspot.com

WAIVER
If we fail at any time to insist upon strict performance of any of your obligations under these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under these terms and conditions, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

SEVER ABILITY
If any of these terms and conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

ENTIRE AGREEMENT
These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the Card and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
We have the right to revise and amend these terms and conditions from time to time. You will be subject to the terms and conditions in force at the time that you purchase the Card from us, unless any change to these terms and conditions is required to be made by law or governmental authority or if we notify you of the change to these terms and conditions in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of notice of the change of terms and conditions.

THIRD PARTY RIGHTS
Except for our affiliates, employees or representatives, a person who is not a party to this agreement has no right under the UK and Ireland Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Contract but this does not affect any right or remedy of a third party that exists or is available apart from the Act.

COMPLAINTS
We operate a complaints handling procedure which is used to try to resolve disputes when they first arise. LAW AND JURISDICTION
These terms and conditions are governed by UK & Irish law. Any dispute arising from, or related to, these terms and conditions shall be subject to the non-exclusive jurisdiction of the courts of England, Ireland, and Wales.
